On October 4, 2023, the State of Hawaii filed a complaint alleging that pharmacy benefit managers CaremarkPCS Health, Express Scripts, and OptumRX engaged in unfair and deceptive practices by manipulating the price of prescription drugs in Hawaii.  The same day, the State moved to seal portions of the complaint that outlined the alleged incriminating evidence of the defendants’ unfair and deceptive practices.

The Law Center opposed the State’s motion to seal.  No. 1CCV-23-1281.  While the motion was pending, the Defendants removed the action to federal court.  No. 23-CV-464.  The federal court (Judge Leslie Kobayashi) required the State to move again to seal the complaint if it wanted the court to consider the unredacted document.  The Defendants subsequently moved to seal limited information in the complaint, which Public First did not oppose.
